Don't Give Up — And Don't Wait Any Longer

Sanctions against your license are separate from the criminal DUI proceedings. After an arrest, you have 20 days to request a Washington Department of Licensing hearing. If you miss the deadline, your license is automatically suspended.

Adults can be suspended for a blood-alcohol content (BAC) of .08. For drivers under 21, the limit is .02. For commercial drivers (CDL), any alcohol driving offense can jeopardize their CDL.

On a typical first-time DUI, you are looking at a 90-day license suspension. Depending on prior offenses, level of intoxication, chemical test refusal or driving on a suspended driver's license, your license could be revoked for one to four years, and you may have to agree to having an ignition interlock installed on your vehicle when your license is reinstated.

The D.O.L. hearing is conducted by telephone. I may challenge the suspension based on lack of probable cause for the DUI stop or subsequent arrest. If your license suspension is upheld, you may be able to qualify for a restricted license so that you can drive to work or school. The hearing also gives us insight into the prosecution's case for your criminal proceedings.

Drivers under 18 are suspended for one year on a first offense, with no restricted license, but I seek to get your license fully reinstated after 90 days. Drivers between 18 and 21 are suspended for 90 days, with a restricted license possible.
